The hotel reserves the right to request an agreed advance payment or security deposit. The amount of the advance payment and the payment dates may be agreed in writing in the contract. Services included in package arrangements that are not used will not be refunded. The hotel does not issue invoices after departure to companies based outside Germany. All services must be paid for at the hotel before departure, either in cash or by credit card. If a company assumes the costs for a guest, the hotel requires a legally binding written declaration of assumption of costs. If a company orders services for a group whose participants pay for themselves, the company must sign a legally binding form accepting liability for the costs in the event of a no-show or departure without payment. Any increase in VAT or introduction of a beverage tax shall be borne by the customer, irrespective of the date on which the contract was concluded.

Group Reservations

The deposit and cancellation conditions for groups are stated in the reservation offer.

Cancellation by the Client / Organizer

Cancellation by the guest of a contract concluded with the hotel requires the hotel’s written consent. If such consent is not granted, the agreed room rental fee or package price stated in the contract, as well as any services arranged with third parties, must in all cases be paid, even if the customer does not make use of the contractual services and the space can no longer be re-let. This does not apply in the event of a breach by the hotel of its obligation to respect the customer’s rights, legal interests and legitimate interests, if this makes it unreasonable for the customer to continue to be bound by the contract, or if another statutory or contractual right of withdrawal exists.

If a date for cancellation has been agreed in writing between the hotel and the guest, the guest may withdraw from the contract up to that date without triggering any payment or compensation claims by the hotel. The customer’s right of withdrawal expires if the customer does not exercise this right in writing towards the hotel by the agreed date.

Cancellations / reductions in the number of participants are possible within the following periods:

  • Up to 4 weeks before the event: free of charge
  • Up to 1 week before the event: 50% of the booked room rental fee or package price
  • Less than 1 week before the event: 30% of the booked room rental fee or package price
  • Cancellations made 12 hours before the start of the event will be charged at 100%.

For bookings made less than 45 days before the start of the event, the above cancellation conditions shall apply immediately upon conclusion of the contract.

Cancellation by the Hotel

If an agreed advance payment is not made even after the expiry of a reasonable grace period set by the hotel, including a warning of refusal, the hotel shall also be entitled to withdraw from the contract.

Furthermore, the hotel shall be entitled to withdraw from the contract for objectively justified reasons, for example if:

a. Force majeure or other circumstances for which the hotel is not responsible make it impossible to fulfil the contract.

b. Events are booked under misleading or false statements regarding essential facts, e.g. concerning the customer or the purpose of the event.

c. The hotel has reasonable grounds to assume that use of the hotel’s services could jeopardize the smooth operation, security or public reputation of the hotel, without this being attributable to the hotel’s sphere of control or organization.

d. There has been a violation of the provisions regarding the conclusion of the contract. The customer shall have no claim for damages against the hotel, except in cases of intentional or grossly negligent conduct by the hotel.

e. If the customer has been granted a written right of withdrawal free of charge within a specified period, the hotel shall also be entitled to withdraw from the contract during this period.

Number of Participants, Event Duration and Rooms

The contractual partner is obliged to provide the hotel with the expected number of participants when placing the booking. The final number of participants must be communicated to the hotel in writing no later than four working days before the event date in order to ensure careful preparation.

A change in the number of participants of more than 5% requires the hotel’s approval. If the number of participants differs by more than 10%, the hotel shall be entitled to adjust the agreed prices and to change the confirmed rooms, unless this would be unreasonable for the customer.

For shared meals (menus and buffets), the organizer must provide the hotel with the exact number of participants three working days before the start of the event. This number shall be deemed the guaranteed minimum number and will be charged to the organizer by the hotel in all cases.

If the hotel has agreed in writing to hold the event with a higher number of participants than originally agreed, there is no obligation on the part of the hotel to grant such approval. The newly agreed number of participants shall be decisive for invoicing, even if the actual number of participants is lower at the time of the event.

Any additional costs incurred as a result of the hotel approving an increased number of participants shall be paid separately, regardless of the actual number of participants at the event, even if the hotel’s approval was granted without expressly referring to these additional costs.

If the agreed start time of an event is changed without the change having been agreed in writing in advance, the hotel shall be entitled to charge the organizer for the service provision costs incurred.

Reserved rooms are only available to the organizer during the period agreed in writing. Use beyond this period requires the hotel’s consent and will generally only be permitted against an additional charge.

The hotel reserves the right to change rooms where this is reasonable for the organizer, taking into account the interests of the hotel.

If the organizer requires access to the rooms before the start of the event for set-up purposes, this is only possible in consultation with the hotel and subject to the corresponding room rental fee.

Last-Minute Bookings

Last-minute booking conditions:

  • The room can no longer be cancelled free of charge.
  • The room must be paid for at the time of booking.

Bringing Food and Beverages

As a general rule, the organizer is not permitted to bring food or beverages to events. Exceptions require a written agreement. In such cases, a contribution towards overhead costs will be charged.

Official Permits / Charges

The organizer is responsible for obtaining all necessary official permits at its own expense, unless expressly agreed otherwise in writing. The organizer is responsible for complying with all relevant regulations. Upon request by the hotel, appropriate proof must be provided.

Any charges payable to third parties in connection with the event, such as GEMA fees, entertainment tax or similar charges, must be paid immediately by the organizer to the respective creditor. The organizer shall indemnify the hotel against such claims upon first written request.

Technical Equipment and Connections

If the hotel procures technical or other equipment from third parties at the organizer’s request, it shall do so in the name, under the authority and for the account of the organizer.

The organizer is responsible for the proper handling and return of such equipment and shall indemnify the hotel against all third-party claims arising from the provision of such equipment.

The use of the organizer’s own electrical equipment using the hotel’s power supply requires the hotel’s written consent. Any malfunctions or damage to the hotel’s technical equipment caused by the use of such devices shall be borne by the organizer, unless the hotel is responsible for such damage.

The hotel may charge a flat rate for electricity costs incurred through the use of such equipment.

The hotel shall not be liable, even in cases of ordinary negligence, for damage to or loss of items brought into the hotel. The hotel does not provide insurance coverage for items brought onto the premises.

Adequate insurance coverage for exhibits, seminar equipment and conference equipment is solely the responsibility of the client / organizer.

With the hotel’s consent, the organizer is entitled to use its own telephone, fax and data transmission equipment. The hotel may charge a connection fee for this.

If the organizer’s own equipment causes suitable hotel equipment to remain unused, the hotel may charge compensation for the resulting loss of revenue.

Malfunctions affecting technical or other equipment provided by the hotel will be rectified immediately wherever possible. Payments may not be withheld or reduced insofar as the hotel is not responsible for the malfunction.

Transport packaging, outer packaging and all other packaging materials brought onto the premises must be disposed of by the client at their own expense. If the client leaves the packaging behind after the event, the hotel may dispose of it for a fee of at least €30.00.

Loss of or Damage to Items Brought onto the Premises

Exhibits and other items, including personal belongings, brought onto the premises remain in the event rooms or hotel at the organizer’s own risk.

The hotel assumes no liability for loss, destruction or damage, except in cases of gross negligence or intentional misconduct by the hotel.

Any decorative materials brought onto the premises must comply with fire safety regulations. The hotel is entitled to request official proof of compliance.

Due to the possibility of damage, the installation and removal of objects must be agreed with the hotel in advance.

Exhibits and other items brought onto the premises must be removed immediately after the end of the event. If the organizer fails to do so, the hotel may remove and store the items at the organizer’s expense.

If items remain in the event room, the hotel may charge a room rental fee for the duration of their stay.

The organizer shall remain entitled to prove that the actual damage was lower, while the hotel shall remain entitled to prove that the actual damage was higher.

Organizer’s Liability for Damage

The organizer shall be liable for all damage to the building or inventory caused by event participants or visitors, employees, other third parties from the organizer’s sphere of responsibility, or the organizer itself.

The hotel may require the organizer to provide appropriate security, such as insurance, deposits or guarantees.

Version February 2021

GENERAL TERMS AND CONDITIONS FOR TAKE-AWAY / TICKET SALES

1. Scope

These General Terms and Conditions apply to the delivery of goods and services that the customer has previously ordered from us via the internet, by telephone or in person.

2. Orders

a) The customer orders the desired goods in customary commercial quantities. All our goods are produced using traditional craftsmanship. As these are food products, the order is binding and excluded from exchange or return. Quantities exceeding this require a separate agreement (please use the contact form).

b) We reserve the right to refuse delivery in individual cases. This applies in particular if the delivery address is outside the delivery area or if a customer could not be found at the delivery address during a previous delivery attempt.

c) Orders can only be accepted during opening hours. We will endeavour to have an order ready for collection within 30 minutes of the order being placed.

d) Ticket sales for workshops: purchase of the ticket is binding; no refund will be provided in the event of cancellation for reasons for which the hotel is not responsible.

3. Prices

The prices stated include the currently applicable VAT. We reserve the right to change prices.

4. Right of Withdrawal

In the case of the purchase of perishable goods, particularly food prepared at the customer’s request, goods whose expiry date may be reached quickly, or goods manufactured according to the customer’s specifications or clearly tailored to the customer’s personal requirements, the customer may only withdraw from the contract as long as the order has not yet been produced or the goods required for production have not yet been purchased.

After this point, the customer may no longer withdraw from the contract. The customer’s statutory warranty rights remain unaffected.

4. Delivery

Delivery will be made to the address specified by the customer within the selected delivery time window. Only one delivery address may be specified per order.

If the delivery address is incorrect or incomplete, or if the recipient is unknown at the address provided, the customer shall be responsible. In such cases, we reserve the right to charge the full amount.

For delivery to a business address, e.g. a company, restaurant or hotel, delivery to an employee available at the location and authorized to accept the delivery shall be deemed completed.

During the ordering process, however, the customer may select self-collection as an option or add a corresponding note.

As a general rule, the delivery location is the customer’s house or apartment door.

Special delivery locations must be agreed before delivery.

A minimum order value of €25.00 applies exclusively to deliveries.

5. Payment

The customer pays for the ordered goods upon delivery. The employee making the delivery is authorized to collect payment upon handing over the goods.

Payment must be made in cash upon delivery. For larger orders, advance payment may be agreed.

The customer should have the invoice amount ready in cash, preferably in the exact amount.

The receipt provided to the customer upon payment also serves as the delivery note and invoice.

6. Warranty

The statutory warranty rights apply.

7. Force Majeure

If we are unable to provide the agreed service due to force majeure, in particular natural disasters, we shall be released from our obligation to perform for the duration of the impediment, and you shall be entitled to withdraw from the contract.

8. Liability

Any liability arising from the delivery agreement is limited to the value of the goods ordered, unless the damage was caused intentionally or through gross negligence.

At the place where the customer receives the ordered goods, generally at the customer’s house or apartment door, the risk of loss, damage or spoilage of the goods passes to the customer.

9. Joke Orders and Their Consequences

By confirming the order and accepting the General Terms and Conditions, the customer submits a clear and binding order and is responsible for payment of the goods upon delivery.

In the case of false or joke orders, we will report the matter to the authorities and claim compensation for any resulting damage.

10. Data Storage – Data Protection

The customer’s personal data required for processing the order, particularly for orders placed through our online services, will be stored.

The customer expressly consents to this.

All personal data will, of course, be treated confidentially.

11. Promotional Offers

We always endeavour to keep sufficient quantities of promotional goods in stock.

However, if an item is unavailable due to high demand, there shall be no entitlement to delivery.

This applies in particular to our online services and the offers listed under the “Offers” link.

12. Validity / Price Changes

We reserve the right to make price changes resulting from price increases by manufacturers or suppliers or from fiscal measures.

This also applies to goods advertised at permanently reduced prices.

Upon publication of a new edition of our offers under the “Offers” link, all previous offers shall cease to be valid.

13. Severability Clause

If individual provisions of these General Terms and Conditions are wholly or partially invalid or subsequently lose their legal validity, this shall not affect the validity of the remaining provisions.

The statutory provisions shall replace any invalid provision.

The same shall apply insofar as these General Terms and Conditions contain an unforeseen omission.

14. Applicable Law

German law shall apply to the execution of the contract.
